The Pension Reform Act 2014 – Nigeria

On the 1st of July 2014 the President of the Federal Republic of Nigeria signed the Pension Reform Act 2014 (The Act) into Law. The Act repeals the Pension Reform Act No.2 Laws of the Federation of Nigeria 2004 and is in force to regulate the administration of uniform contributory Pension Scheme for both the private and public sector in Nigeria. To ensure that every person who works in either the Public Service of the Federation Federal Capital Territory, States and Local Governments or the Private Sector, receives retirement benefits as and when due.

Intellectual Property – News and Update (01.03.2014)

On Tuesday the 4th of February 2013 the Federal Government of Nigeria launched the Intellectual Property Automated System (IPAS). Tagged, by the Minister of Trade, Industry and Investment, as the largest system of automated processing of Trademark, Patent and Industrial Design applications in Africa, the IPAS is expected to create a more efficient, cost effective and transparent process of Trade Mark, Patent and Industrial Design registration.

Banking – The Scope of Banking Business Defined (31.10.2012)

Recently, Honourable Justice B.F.M Nyako of the Federal High Court, Lagos, Nigeria, was invited to determine the legality of a series of banking transactions, carried out partly in Nigeria and partly overseas, for the purpose of determining the enforceability of the contract and the Court empowered with Jurisdiction to adjudicate over the issues arising there from.

Aviation – Liability for Loss, Destruction and Damage to Baggage and Cargo (01.10.2012)

By Presidential assent Nigeria’s most recent Civil Aviation Act aptly named the Nigerian Civil Aviation Act 2006 (The Act) was duly signed into law by the then President of the Federal Republic of Nigeria, Chief Olusegun Obasanjo, on the 14th of November 2006.

Aviation – Liability of Carrier in case of Death (05.06.2012)

LIABILITY OF CARRIER IN CASE OF DEATH Sunday 3rd June, 2012 was gory not only for the residents of Iju-Ishaga area of Lagos State, Nigeria, but for the entire nation due to the fatal air crash, involving a Dana passenger plane MD 83 which killed all 153 (One Hundred and Fifty-Three) passengers including the crew members. The said air mishap continues to generate comments from several quarters especially with regards to payment of “adequate” compensation to relatives of the victims.

This précis briefly examines the legal framework regulating the Aviation Industry in Nigeria, with particular focus on the liability of the Carrier and extent of Compensation for damage for death and injury of passengers.

Aviation – Establishing a foreign Airline in Nigeria (31.01.2012)

Prior to operating foreign air services in Nigeria there must exist a Bilateral Air Service Agreement (BASA) between Nigeria and the foreign air operators’ Country of origin. Once BASA is signed between the two Countries an airline is duly designated by the respective Nation as having the rights to transport persons, cargo and mail, between the two Countries. Where a Country fails to designate a carrier, on its part, it does not preclude the other from proceeding with appointing its designee. Before commencing flight operations, in Nigeria, the designated Airline must do the following:
