Aviation – Liability of Carrier in case of Death (05.06.2012)

LIABILITY OF CARRIER IN CASE OF DEATH Sunday 3rd June, 2012 was gory not only for the residents of Iju-Ishaga area of Lagos State, Nigeria, but for the entire nation due to the fatal air crash, involving a Dana passenger plane MD 83 which killed all 153 (One Hundred and Fifty-Three) passengers including the crew members. The said air mishap continues to generate comments from several quarters especially with regards to payment of “adequate” compensation to relatives of the victims.

This précis briefly examines the legal framework regulating the Aviation Industry in Nigeria, with particular focus on the liability of the Carrier and extent of Compensation for damage for death and injury of passengers.
